GENERAL

The General Terms and Conditions of Kuga Studio (hereinafter referred to as the “General Terms and Conditions”) govern the business operations of Kuga Studio and ŠKD Sajfr (hereinafter collectively referred to as “Kuga Studio”) and are binding for anyone who enters into a contractual relationship with Kuga Studio.

COMMENCEMENT OF THE CONTRACTUAL RELATIONSHIP

The contractual relationship between Kuga Studio, as the provider and performer of services, and the recipient of the offer (hereinafter referred to as the “client” or “participant”) begins at the moment the client submits a completed membership application in physical form. The application cannot be submitted if the client does not agree with the General Terms and Conditions.

By entering into a contractual relationship with Kuga Studio (ŠKD Sajfr), the client agrees to comply with and act in accordance with the General Terms and Conditions. The client is also considered to have accepted the General Terms and Conditions if they pay the training fee prior to submitting the application.

For minors, the application form must be completed and submitted by their legal representative (parent or guardian), who is considered the recipient of the offer and the contractual party in this case.

ENROLLMENT IN COURSES

Participants enroll in dance courses by completing the registration form with the required information and submitting it via the website kugastudio.com or a Google Form link.

Upon registration, each member completes a membership application with their personal information, which is processed in accordance with the Personal Data Protection Act. For minors, the application must be completed by a parent or guardian; for participants aged 18 and above, the form is completed by the participant themselves.

The course fee is paid as a training fee for a specific period (usually for the current month) covered by the chosen course. To continue training, the training fee must be paid upon receipt of the invoice by the due date; otherwise, the participant will not be able to attend classes or training at the next level of the course. Private lessons must also be paid in advance (before the training).

The course fee is paid by settling the invoice received via the email address provided in the registration form.

Courses are charged in accordance with the valid price list published on kugastudio.com and displayed at Kuga Studio premises. On the first invoice of each new season, an annual membership fee of €40 is charged. This fee applies to all regular Kuga Studio programs and covers administrative and organizational costs.

If, after registering and attending one introductory class, the participant decides not to continue attending the dance program, the participant (or their parents/guardians) may withdraw from the application by sending a written notice via email to info@kugastudio.com. In this case, the membership fee and any paid training fees are non-refundable.

During the year, a participant may withdraw from a dance program by notifying Kuga Studio via email at any time. However, training fees already paid for the current month are non-refundable.

The regular educational activity of dance classes at Kuga Studio takes place according to planned schedules every day of the week from September 29 to June 30, covering a total duration of nine months per year. Classes do not take place during public holidays and school breaks throughout the year, as well as during the summer school holidays, unless a personal arrangement is made with the trainer.

During the summer school holidays (July and August), activities at Kuga Studio are carried out on a project basis.

LIABILITY

Participation in Kuga Studio’s dance classes and other programs is entirely voluntary and takes place at the participant’s own risk or that of their legal representatives (parents or guardians). Kuga Studio accepts no responsibility for any injuries, damages, or consequences that may occur during participation.

Accident insurance for participants is not included in the price of Kuga Studio’s services.

PRICE LIST OF SERVICES

The price list of Kuga Studio’s services is published on kugastudio.com. Kuga Studio reserves the right to change the schedule, prices, and payment terms at any time during the calendar year.

Any changes take effect and apply from the date they are published on the aforementioned website and in the Kuga Studio premises, unless otherwise specified that they will take effect at a later date.

The price list may include various discounts. Discounts offered through promotional campaigns cannot be combined with the discounts listed in the regular price list. Discounts are only valid if the entire program is paid by the specified due date and cannot be combined with other discounts.

PAYMENT METHODS AND TERMS

Payments for services are accepted exclusively on the basis of issued invoices. Cash and card payments are not accepted. Invoices for the current month are sent to participants by email, and payment must be made within the deadline stated on the invoice.

Training fees and payments for all other services must be settled before the start of the dance course or other services by transferring the amount to the ŠKD Sajfr transaction account.

If a participant is late with the payment, Kuga Studio will issue a first reminder. If the participant still fails to settle the debt, a second reminder will be sent. The participant will be charged an additional €4.00 fee for each reminder issued.

If the debt remains unpaid after the second reminder, Kuga Studio will initiate enforcement or other legal proceedings against the participant to recover the debt.

ATTENDANCE POLICY

Kuga Studio commits to preparing and delivering dance classes or training in accordance with the agreement and within the published schedule. However, the dance school reserves the right not to conduct certain courses or training programs if an insufficient number of participants register.

The dance school also reserves the right to cancel individual class sessions for objective reasons (e.g., illness or injury of the dance teacher or similar).

If an insufficient number of participants register for a specific skill level or age group, the dance school reserves the right to merge certain levels and/or age groups, provided that the overall difficulty level of the course is not significantly changed.

In the event of a canceled class session, the class will be rescheduled for one week later or moved to the next suitable available date.

Absence of a participant from individual (or multiple) class sessions is not grounds for a refund of the membership fee or training fee, except in cases of absence due to medical reasons, which must be proven with a valid medical certificate confirming the participant’s inability to attend.

In such cases, the training fee is not refunded, but the participant is granted the right to attend the next suitable available class of a comparable group.

Since we offer a minimum of nine classes per week, members who are absent due to illness can make up for their missed sessions in other scheduled classes once they return.

CODE OF CONDUCT DURING CLASSES & LIABILITY FOR PERSONAL BELONGINGS

Participants are required to arrive at dance classes 5–10 minutes before the start, wearing the attire recommended by Kuga Studio at the time of enrollment. Classes begin promptly, and late arrivals disrupt the flow of the class.

For school-aged children, parents must drop them off with the teacher inside Kuga Studio’s premises and pick them up again inside the studio after the class ends. Kuga Studio does not provide additional childcare, and therefore takes responsibility for children only during the duration of the class.

Participants must change clothes and shoes in the changing room before class and wear appropriate dance footwear during training. Street shoes must be left in the changing area before entering the dance hall.

Kuga Studio is not responsible for forgotten or lost belongings. Found items will be stored for a maximum of 30 days, after which they will be donated to charity.

Bringing food and drinks (except closed water bottles) into the studios, using mobile phones during training, or mishandling equipment is strictly prohibited. If a participant fails to comply with these rules, they must leave the space upon request by a staff member or teacher. In such cases, Kuga Studio is not obliged to refund any part of the training fee.

If a participant fails to pay the training fee, they will not be allowed to attend classes until the full outstanding amount is paid.

USE OF STUDIOS

The schedule for studio use is available to all teachers working at Kuga Studio. Participants may use the studios only during their scheduled program times and in the presence of teachers. Any additional use of the studios by teachers must be reported in advance.

Kuga Studio competitors may use the studios only by reserving available time slots in advance and exclusively for competition-related preparation. In all other cases, the studios can only be used during free time slots upon prior reservation and payment of rental fees according to Kuga Studio’s price list or by special arrangement with Kuga Studio.

COURSE AND CLASS DURATION

Course and class durations are listed in the schedule at kugastudio.com. In general, programs are structured in levels consisting of 4 or 8 sessions. Classes may take place once, twice, or multiple times per week and last 45, 60, 75, or 90 minutes, depending on the course schedule. A 10-minute break is provided when needed.

PRIVATE LESSONS

“Private lessons” (for individuals, dance couples, or groups) must be paid for in advance (before the session). Cancellations of private lessons must be made at least 6 hours prior to the scheduled start time. For cancellations made later than this, Kuga Studio is not obliged to refund the training fee.

SCHEDULE

All classes are conducted in accordance with the regular program and scheduled class times. In the event of teacher absence, a substitute will be provided. If a class must be canceled due to force majeure, participants will be notified in a timely manner and the session will be rescheduled for the following week or at another appropriate time.

The duration of each class depends on the specific program and the age group of the participants.

TERMINATION OF THE CONTRACTUAL RELATIONSHIP

The contractual relationship between the participant and Kuga Studio is concluded for an indefinite period (until terminated by either party) and is automatically extended for the duration of the next course after each completed course, unless the participant notifies Kuga Studio in writing via info@kugastudio.com, no later than the last day of the current level/course or within 7 days after stopping attendance, that they do not wish to continue.

Kuga Studio may terminate the contract at the end of a course by notifying the participant personally, by regular mail, or by email at least 7 days in advance.

In exceptional cases, at the discretion of the Kuga Studio President, the contract may also be terminated before the end of a course. In such cases, Kuga Studio must refund the participant a proportional amount of the already paid training fee.

LIABILITY IN CASE OF FORCE MAJEURE

In the event of force majeure—circumstances beyond Kuga Studio’s control that could not be prevented, eliminated, or avoided—and which prevent Kuga Studio from conducting a course as originally agreed, Kuga Studio is not liable for any damages and will not refund already paid training fees.

VALIDITY OF THE GENERAL TERMS AND CONDITIONS

These General Terms and Conditions enter into force on the date of publication and remain in effect until revoked or replaced by updated versions.
